HB 1889: Professional Licenses for All WA’s Immigrants

In 2024, the WA state legislature passed HB 1889, which clarifies the rules for professional licenses to allow all qualified residents, regardless of immigration status, to apply for and receive professional licenses. Further, a state agency or authority cannot deny an application solely on the basis of a person’s immigration status if the person has met all other qualifications.

In this post, we provide basic information that address some questions including what it is, what it does, and our understanding of what it allows regarding employment. What’s HB 1889? What does it do? And how does this benefit me?

HB 1889 is not a work permit, it doesn’t give work authorization, and it’s not immigration reform; unfortunately, this law does not provide a pathway to U.S. Citizenship. In simple terms, this law removes barriers to educational and professional licensures regardless of immigration status.

Who is eligible?

An immigrant individual who is not lawfully present in the United States is eligible. An applicant may provide an individual taxpayer identification (ITIN) number instead of a social security number (SSN). A SSN or ITIN provided to the state is confidential and is exempt from disclosure.

What are the professional licenses covered under this law?

There are more than 120 professions that are impacted by this legislation. Many of those professions require either a professional licensure, certification, or a specialized registration. Who regulates businesses and professions in WA state?

The Department of Licensing regulates the state’s businesses and professions. Each profession & business has a separate set of laws and sometimes is overseen by a board or commission.

Who regulates education certification in WA state?

The Professional Educator Standards Board establishes and enforces rules for eligibility for K-12 staff. This includes teachers, school counselors, school psychologists, school social workers, and para-educators.

What professions are exempt from this law?

The law doesn’t apply to: Bail bond recovery agent, Private investigators, and Security guards.

If you qualify under this law, what can you do?
